2. Educational Purpose Only

Our content and services are provided for educational, informational, and exam-preparation purposes only.

Our materials may include medical, clinical, exam-preparation, or professional-development content. However, our content does not replace:

  • formal medical training;
  • professional clinical judgement;
  • advice from a licensed healthcare professional;
  • current clinical guidelines;
  • official examination body materials;
  • legal, immigration, employment, regulatory, taxation, accounting, or financial advice; or
  • individual assessment by a relevant professional, organisation, regulator, institution, or authority.

You are responsible for verifying information against current official guidelines, examination requirements, institutional policies, regulatory requirements, and applicable professional standards.

3. No Doctor-Patient Relationship

Use of our website, courses, consultations, educational materials, live sessions, shared folders, communications, or digital resources does not create a doctor-patient relationship between you and Smart IMG Academy, Smart Medical Australia Pty Ltd, any instructor, contractor, or representative.

Our educational services are not medical consultations and must not be used as a substitute for medical advice, diagnosis, treatment, emergency care, or individual clinical decision-making.

4. No Guarantee of Examination or Professional Outcome

We may provide educational resources intended to support examination preparation and professional learning. However, we do not guarantee:

  • passing any examination;
  • achieving a particular score;
  • score improvement;
  • acceptance by any examination body;
  • registration, licensing, credentialing, or employment;
  • immigration or visa outcomes;
  • clinical competency outcomes;
  • income, career, or business outcomes; or
  • any specific result from using our services.

Your outcome depends on many factors, including your prior knowledge, attendance, preparation, study habits, language skills, examination performance, regulatory requirements, and decisions made by third-party bodies.

5. Eligibility and Account Responsibility

You must provide accurate, complete, and current information when creating an account, placing an order, enrolling in a course, requesting access, or communicating with us.

You are responsible for:

  • maintaining the confidentiality of your login details;
  • all activity under your account;
  • ensuring your email address and contact details are correct;
  • checking spam, junk, and email-filtering systems for our messages; and
  • notifying us promptly if you suspect unauthorised access to your account.

You must not share your login details, course access, shared-folder links, passwords, recordings, digital resources, purchased materials, Microsoft Teams access, live-session links, or other restricted resources with any other person unless we have given written permission.

6. Course and Product Information

We aim to describe our courses, products, services, prices, inclusions, access periods, and technical requirements as accurately as possible.

Before purchasing, you are responsible for reviewing:

  • the course or product description;
  • the price and currency;
  • what is included and excluded;
  • course dates, times, deadlines, and access periods;
  • refund, cancellation, transfer, and missed-session rules;
  • any eligibility requirements;
  • any technical requirements; and
  • whether the course, product, consultation, or service is suitable for your needs.

If you are unsure whether a course, product, consultation, or service is suitable for you, please contact us before purchasing.

7. Availability of Courses and Services

Some courses, batches, consultations, digital products, or services may be available only at selected times or for selected students.

We may open, close, pause, reschedule, modify, or discontinue a course, product, batch, consultation, or service where reasonably necessary. This may occur because of instructor availability, enrolment numbers, examination timing changes, technical issues, operational reasons, or circumstances beyond our reasonable control.

If a service is marked as unavailable, not currently open for enrolment, hidden from the shop, password-protected, or available only by direct link, you must not treat that service as generally available for purchase.

8. Orders, Enrolment, and Access

An order, registration, or enrolment is not confirmed until we have received or approved payment and issued confirmation or access instructions.

After purchase, access may be provided by website account, email, direct link, live-session link, downloadable file, shared folder, password-protected access, Microsoft Teams course group, Zoom link, or another method specified by us.

Unless Smart IMG Academy agrees otherwise in writing, access to live sessions, Microsoft Teams course groups, Course Notes, Extra Notes, digital materials, shared-folder access, passwords, or other restricted resources is provided only after:

  1. the required registration or order process has been completed;
  2. the full agreed payable amount has been received and confirmed by Smart IMG Academy;
  3. the Confidentiality Agreement process has been completed, where required;
  4. required identification documents have been provided and accepted, where required; and
  5. any required course group or access setup has been completed.

Any deposit, partial payment, instalment, or payment arrangement does not automatically entitle you to access unless Smart IMG Academy confirms that access in writing.

If access is provided by mistake, system error, or administrative error before the required onboarding steps are complete, Smart IMG Academy may immediately suspend or withdraw access without prior notice until all required steps are completed.

You are responsible for ensuring that you can access the relevant technology, including a stable internet connection, suitable device, compatible browser, email access, Zoom, Microsoft Teams, and any required software or platform.

9. Payments, Currency, Payment Methods, Price Changes, Taxes, and Receipts

Unless otherwise stated, prices on smartimgacademy.ca are listed in Canadian dollars (CAD). Any dollar amount in these Terms and Conditions is in CAD unless stated otherwise.

Approved payment methods may include one or more of the following:

  • CAD domestic bank transfer or EFT using the account details provided;
  • Interac e-Transfer, only if specifically offered by us for that payment;
  • card payment through checkout or an approved payment link;
  • direct bank transfer; or
  • another payment method approved by us in writing.

You must follow the payment instructions provided at checkout or by us directly. Unless we specifically instruct otherwise, you should not send payment by Canadian wire transfer, Online Bill Transfer, bill payment, or any unapproved payment method. If you use an incorrect or unsupported payment method, the payment may be delayed, rejected, returned, or subject to deductions or return fees by the payment provider or financial institution.

You are responsible for any bank fees, card fees, international transaction fees, currency conversion fees, payment-provider fees, return fees, or charges imposed by your bank, card issuer, or payment provider.

The account holder name for some payment methods may appear as Smart Medical Australia Pty Ltd. This is because Smart IMG Academy is a trading name of Smart Medical Australia Pty Ltd.

All fees, discounts, packages, and offers are subject to availability, eligibility, approval, and current written terms.

Smart IMG Academy may update, change, withdraw, or correct fees, discounts, packages, or offers at any time before registration/order and payment are confirmed.

Once a participant’s registration/order has been accepted and the full agreed payable amount has been received and confirmed by Smart IMG Academy, the confirmed fee for that registration will generally be honoured, unless there has been an obvious pricing error, payment issue, agreed change to the service/package, or other exceptional circumstance.

Unless expressly stated otherwise, course fees are listed in CAD and do not include GST, HST, VAT, QST, PST, or other taxes.

Smart IMG Academy is not currently adding or collecting such taxes at checkout unless expressly stated.

If tax collection becomes required by applicable law, or if our accountant, adviser, payment provider, or a tax authority confirms that tax applies, applicable taxes may be added to current or future fees, invoices, or payments.

Smart IMG Academy may provide a payment receipt or invoice. Whether a payment is tax-deductible or claimable depends on your own circumstances. You should seek your own tax advice if needed.

10. Payment Verification and Delayed Access

We may delay access to a course, product, consultation, Course Notes, Extra Notes, shared folder, live session, Microsoft Teams course group, recording, or digital material until payment has been received, cleared, matched to your order, and verified.

If payment is made by manual transfer, you may be asked to provide proof of payment. Providing proof of payment does not guarantee immediate access if the funds have not cleared or cannot be matched to your order.

If payment is not received within the required timeframe, we may cancel the order, release the seat to another participant, or require a new order to be placed.

11. Access Period and Course End Date

Access to courses, Course Notes, Extra Notes, digital products, downloadable materials, shared folders, Microsoft Teams course groups, or learning resources may be limited to a specific access period.

Unless otherwise stated on the course page or in written communication from us, access is available until the course end date.

Unless otherwise stated, the course end date is one month after the course start date. The course end date may be extended or adjusted because of holidays, public holidays, scheduling issues, instructor availability, examination timing, or other events affecting delivery of the course.

After the access period or course end date expires, we may remove access without further notice unless an extension is purchased or granted in writing.

Expiry, completion, cancellation, suspension, or termination of access does not give you any right to share, upload, publish, sell, transfer, teach from, commercially use, or otherwise misuse Smart IMG Academy materials or restricted resources. Any materials already properly provided to you for permitted personal study remain confidential and remain subject to these Terms and Conditions and any applicable Confidentiality Agreement.

12. Live Sessions, Webinars, Consultations, and Scheduling

If your purchase includes live sessions, webinars, group teaching, or scheduled consultations, the dates and times will be provided on the relevant product page, course page, email confirmation, Microsoft Teams course group, or student communication channel.

Live online sessions are delivered primarily through Zoom unless we state otherwise in writing.

Zoom session links and related live-session access information may be provided inside the current Microsoft Teams course group. Microsoft Teams may also be used as the backup live-session platform if Zoom is unavailable or unsuitable.

Participants are responsible for checking the course schedule carefully and confirming the relevant time zone for live sessions, including any daylight-saving or local time differences.

Participants are required to keep their video/camera turned on throughout live Zoom course sessions, unless Smart IMG Academy approves a reasonable exception for a genuine technical, medical, privacy, or other reasonable issue.

Participants are encouraged to join Zoom sessions using a laptop or desktop computer rather than a mobile phone, where possible, for the best experience.

Participants are also encouraged to sign in to their own Zoom account before joining the session. A free Zoom account is sufficient.

Sessions are offered as live sessions and are not officially recorded for participant access unless we clearly state otherwise in writing.

Smart IMG Academy may internally record or review sessions where reasonably necessary for quality assurance, training, compliance, audit, course improvement, research and development, administrative, legal, or enforcement purposes. Any internal recording or review does not create a right for participants to receive a recording.

We may reschedule, modify, replace, or cancel a live session where reasonably necessary. If we cancel or materially reschedule a paid live session, we may provide one or more of the following depending on the circumstances:

  • a replacement session;
  • alternative educational material;
  • transfer to another batch or course;
  • credit toward a future service; or
  • another remedy required by applicable law.

You are responsible for attending at the scheduled time. If you miss a live session, our Missed Sessions Policy applies.

13. Course Notes, TDM Extra Notes, and Digital Materials

TDM Course Notes and other digital course materials may be provided through a secure shared folder, direct link, password-protected access, email, website account, or another method chosen by us.

A Shared Folder is a method of providing access to restricted resources. It is not a separate service by itself.

Once Course Notes, TDM Extra Notes, or other digital materials have been made available to you, they are considered accessed or provided for the purposes of our refund policy, whether or not you download, save, print, copy, open, read, or fully use them.

Because digital materials can be viewed, copied, downloaded, saved, or printed once access has been provided, they are not separately refundable except where required by applicable law.

TDM Course Notes may be included as part of selected eligible course packages and are not separately refundable once made available, except where required by applicable law.

TDM Extra Notes, if offered, are available only to eligible current students or eligible previous students. They are not available for general public purchase.

Course Notes, Extra Notes, digital materials, shared-folder links, passwords, and other restricted resources are provided only to the registered participant for their own private study and exam preparation.

14. Confidentiality Agreement and Restricted Course Resources

You may be required to sign or accept a separate Confidentiality Agreement before receiving access to live sessions, Microsoft Teams course groups, Course Notes, Extra Notes, digital materials, shared folders, discussion groups, or other restricted course resources.

If there is any inconsistency between these Terms and Conditions and a signed Confidentiality Agreement, the Confidentiality Agreement will apply to the extent of the inconsistency for confidentiality, intellectual property, recording, copying, sharing, uploading, AI processing, third-party processing, and misuse of restricted materials.

Smart IMG Academy course materials, live-session content, Course Notes, Extra Notes, digital materials, links, passwords, and restricted resources are confidential.

You must not share, copy, upload, publish, distribute, sell, transfer, record, screenshot, photograph, scan, or otherwise misuse Course Notes, Extra Notes, digital materials, live-session content, links, passwords, or other restricted resources.

You must not upload, enter, paste, process, summarise, analyse, transcribe, store, or share any course material or live-session content using artificial intelligence tools, chatbots, transcription tools, cloud services, file-sharing services, messaging groups, social media platforms, third-party websites, or third-party applications without prior written permission from Smart IMG Academy.

Any breach of confidentiality, unauthorised sharing, copying, recording, distribution, publication, uploading, AI processing, third-party processing, or misuse of our course materials may result in immediate suspension or termination of access without refund. We may also seek legal remedies, including damages, injunctions, recovery of costs, and any other remedies available under applicable law.

15. Refunds, Cancellations, and Transfers

Our refund, cancellation, transfer, and change-request rules depend on the type of product or service purchased.

Nothing in this policy limits, excludes, or modifies any rights you may have under applicable consumer protection laws.

15.1 No Refund After Course Notes, Extra Notes, Digital Materials, or Live Session Start

No refund is available after Course Notes, Extra Notes, or digital course materials have been made available to you, or after live sessions have started, whichever occurs first, except where required by applicable law.

If Course Notes, Extra Notes, or digital course materials have been made available to you, no refund is available even if you have not downloaded, saved, printed, copied, opened, read, or fully used them.

Transfer to a future course may be considered at our discretion, subject to these Terms and Conditions, availability, scheduling, and approval. This does not create an automatic right to a transfer.

15.2 Cancellation More Than 72 Hours Before Course Start

If Course Notes, Extra Notes, or digital course materials have not been made available to you and live sessions have not started, and you request cancellation more than 72 hours before the course start time, the refund will be:

Paid amount minus CAD $100 administration fee.

15.3 Cancellation Within 72 Hours Before Course Start

If Course Notes, Extra Notes, or digital course materials have not been made available to you and live sessions have not started, and you request cancellation within 72 hours before the course start time, the refund will be:

Paid amount minus CAD $100 administration fee minus 20% of the relevant course or service fee.

This late cancellation fee reflects administrative work, limited course capacity, preparation time, payment processing, and the reduced opportunity to offer the place to another participant at short notice.

15.4 Cancellation After Course Start

After the course has started, no refund is available, except where required by applicable law.

For serious unforeseen life events, we may consider transfer to a future course at our discretion, subject to availability, scheduling, prior approval, and these Terms and Conditions. This does not create an automatic right to a refund or transfer.

15.5 Refund Method and Processing Time

Approved refunds will usually be processed within 5 to 10 business days after approval.

The time required for funds to appear in your account may vary depending on your bank, card issuer, payment provider, currency conversion process, and international payment-processing times.

Payment-provider fees, bank fees, card fees, international transaction fees, currency-conversion fees, and return fees may not be refundable unless required by law.

16. Change Requests, Transfer Fees, and Late Registration

A CAD $100 administration fee may apply to approved change requests that require administrative processing, including course transfer requests, late registration changes, participant substitution requests, or other material changes requested by the participant.

We will tell you before applying this fee. The fee does not apply where the change is required because of an error by us or where applicable law requires otherwise.

If registration is accepted after the registration deadline, a CAD $100 late registration administration fee may apply. Late registration is subject to availability, approval, remaining course capacity, payment confirmation, Confidentiality Agreement completion, required ID verification, and administrative feasibility.

Late registration does not guarantee immediate access, make-up sessions, extensions, discounts, refunds, or access to missed live sessions unless specifically approved in writing by Smart IMG Academy.

Minor spelling, contact-detail, or administrative corrections usually do not attract an administration fee.

A participant or registration change requiring re-onboarding, a new Confidentiality Agreement, new ID verification, or new or reissued access to restricted course resources may attract a CAD $100 administration fee if approved.

Changing the registered participant to a different person is not automatically available. If approved, it will be treated as a major administrative change and may require new registration details, new ID verification, a new Confidentiality Agreement, and new access setup.

17. Whole-Course Transfer

Before the course starts, a participant may request transfer of their whole course enrolment to a future course.

Approval is at our discretion and subject to availability, scheduling, prior approval, administrative feasibility, and payment of a CAD $100 course-transfer administration fee, unless we waive the fee in writing.

After the course has started, whole-course transfer is not normally available.

However, for serious unforeseen life events, we may consider transfer to a future course at our discretion, subject to availability, scheduling, prior approval, and payment of a CAD $100 course-transfer administration fee unless we waive the fee in writing.

After 12 months from the original course start date, a new registration is usually required unless we agree otherwise in writing.

18. Missed Sessions Policy

Participants are responsible for attending scheduled live sessions.

Missed-session make-up access is discretionary only and is not automatic.

Where available and approved, a participant may be allowed to attend a make-up session for the specific missed session.

For the same target exam cycle, missed-session make-up may be provided free of charge if available and approved by Smart IMG Academy.

Outside the same target exam cycle, a missed-session make-up may attract an administration fee of CAD $100, if available and approved.

There is no automatic right to repeat the whole course because of missed sessions.

Missed sessions or no-shows do not automatically entitle the participant to a refund.

19. Promotions, Coupons, Discounts, and Add-Ons

We may offer promotions, coupons, discounts, package pricing, referral appreciation, group discounts, or add-on offers from time to time.

Unless otherwise stated:

  • promotions cannot be combined;
  • promotions cannot be applied retrospectively to past purchases;
  • promotions have no cash value;
  • promotions may be withdrawn or changed before registration/order and payment are confirmed;
  • eligibility conditions may apply; and
  • discounts apply only during the stated promotional period or checkout process.

Any package, bundle, discount, or offer is subject to availability, eligibility, approval, and current written terms.

20. Intellectual Property

All content on our website and in our courses, recordings, Course Notes, TDM Extra Notes, digital products, shared folders, slides, question materials, explanations, templates, documents, videos, images, downloads, and related resources is owned by us or licensed to us unless otherwise stated.

When you purchase or access our materials, you receive a limited, personal, non-exclusive, non-transferable permission to use those materials for your own private educational purposes only, subject to these Terms and Conditions and any applicable Confidentiality Agreement.

You must not:

  • copy, reproduce, distribute, publish, upload, sell, resell, license, rent, or commercially exploit our materials;
  • share your account, access, links, passwords, shared folders, recordings, or downloaded files;
  • create derivative products or competing educational materials from our content;
  • remove copyright notices, watermarks, or branding;
  • record live sessions without permission;
  • upload, enter, paste, process, summarise, analyse, transcribe, store, or share our materials using artificial intelligence tools, chatbots, transcription tools, cloud services, file-sharing services, messaging groups, social media platforms, third-party websites, or third-party applications without prior written permission; or
  • use our materials in a way that infringes our rights or the rights of others.

Breach of this section may result in immediate suspension or termination of access without refund, and we may take further action where appropriate.

21. Acceptable Use

You must use our website and services lawfully and respectfully.

You must not:

  • misuse our website, payment systems, accounts, shared folders, course platforms, Zoom links, Microsoft Teams course groups, or restricted resources;
  • attempt to gain unauthorised access to our systems or materials;
  • interfere with website security or functionality;
  • upload malicious code, viruses, or harmful files;
  • harass, abuse, threaten, or defame any person;
  • submit false, misleading, fraudulent, or unlawful information;
  • infringe intellectual property rights;
  • share restricted content or access with unauthorised persons; or
  • engage in conduct that may harm Smart IMG Academy, Smart Medical Australia Pty Ltd, our students, instructors, contractors, systems, or reputation.

22. Student Conduct and Communication

We may provide support or communication through email, website forms, messaging applications, online meeting platforms, Microsoft Teams, Zoom, or other channels.

You agree to communicate respectfully with us, our instructors, contractors, representatives, and other students.

Questions, clarification requests, respectful disagreement, and good-faith concerns are welcome. Communication should remain respectful and should not interfere with the learning environment, course delivery, confidentiality, safety, or administration of the course.

Unprofessional or disruptive behaviour means serious or repeated conduct that is abusive, threatening, harassing, discriminatory, dishonest, substantially disruptive to live sessions, or likely to affect the learning environment, instructor, staff, participants, confidentiality, safety, or proper course operation.

Reasonable questions, respectful disagreement, technical difficulty, clarification requests, or good-faith complaints are not considered unprofessional behaviour.

We will generally try to give a warning or reminder before restricting live-session participation for minor or first-time conduct issues, where practical. However, serious conduct may result in immediate restriction or removal from live sessions or communication channels without prior warning.

If the issue is disruptive behaviour that does not involve breach of confidentiality, unauthorised sharing, misuse of materials, non-payment, fraud, or similar serious access-related misconduct, the remedy should generally be limited to restricting live-session attendance, live participation, or direct instructor communication. Access to Course Notes or digital materials already properly provided should not be automatically withdrawn for non-confidentiality-related behaviour.

If the issue involves confidentiality breach, unauthorised sharing, misuse of materials, non-payment, fraud, or similar serious access-related misconduct, Smart IMG Academy may suspend or remove access to restricted resources and may take further action under these Terms and Conditions, the Confidentiality Agreement, or applicable law.

23. User-Submitted Content

If you submit questions, comments, feedback, reviews, testimonials, assignments, messages, or other content to us, you confirm that your submission is accurate, lawful, and does not infringe the rights of any third party.

We may use feedback or testimonials for business, educational, quality-improvement, or promotional purposes unless you clearly tell us not to do so. We may edit testimonials for clarity, length, or privacy, provided we do not materially misrepresent your feedback.

24. Privacy and Personal Information

We collect, use, store, and disclose personal information in accordance with our Privacy Policy, where available, and applicable privacy requirements.

Personal information may include your name, email address, phone number, billing details, order details, course enrolment details, account details, payment status, communication history, identity-verification information where required, and information you submit through our website, shared folders, payment processes, or communications.

Personal information and verification information may be used for purposes including order processing, account access, course delivery, payment processing, customer support, compliance, record keeping, service improvement, access control, confidentiality protection, misuse investigation, enforcement, and communications related to your purchase or enrolment.

Where identification documents are required, we may request, receive, review, store, and retain identification documents and verification information for as long as reasonably necessary for verification, administration, confidentiality protection, misuse investigation, enforcement, legal, accounting, or record-keeping purposes, or as otherwise required or permitted by applicable law.

Our Privacy Policy is to be added once available.

25. Email and Marketing Communications

We may send transactional or service-related emails, including order confirmations, payment instructions, access details, course updates, receipts, account notices, and support replies.

We may send marketing or promotional messages only where permitted by applicable law. Marketing messages may include an unsubscribe option where required.

Unsubscribing from marketing messages does not stop necessary transactional or service-related communications.

26. Third-Party Services

Our website and services may use third-party providers, including payment processors, banks, email systems, hosting providers, video platforms, online meeting platforms, learning platforms, analytics tools, security tools, WordPress plugins, WooCommerce extensions, shared-folder platforms, cloud-storage platforms, and other technology providers.

We are not responsible for the availability, security, performance, fees, delays, errors, policies, or practices of third-party services except where required by law.

Your use of third-party services may also be subject to their own terms, conditions, privacy policies, and fees.

27. Website Availability and Technical Issues

We aim to keep our website and services available and functional, but we do not guarantee uninterrupted access.

Access may be affected by maintenance, updates, hosting issues, internet issues, software errors, cyberattacks, payment-gateway problems, shared-folder access issues, third-party service outages, or circumstances beyond our reasonable control.

You are responsible for your own device, internet connection, browser, email access, software, Zoom access, Microsoft Teams access, camera, microphone, speaker/headphones, and technical setup.

28. Changes to Services and Content

We may update, improve, modify, replace, or remove course content, materials, dates, products, pricing, instructors, access methods, or service features from time to time.

We may make changes to correct errors, update information, improve quality, respond to examination changes, comply with law, or improve the student experience.

Where a change materially affects a paid service you have already purchased, we will act reasonably and in accordance with applicable law.

29. Limitation of Liability

To the maximum extent permitted by law, Smart Medical Australia Pty Ltd trading as Smart IMG Academy is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of income, loss of opportunity, loss of data, loss of business, examination failure, licensing outcomes, registration outcomes, professional consequences, or reliance on educational content.

To the maximum extent permitted by law, our total liability for any claim related to a product or service is limited to the amount you paid for that specific product or service.

Nothing in these Terms and Conditions excludes, restricts, or modifies any right, guarantee, remedy, or liability that cannot lawfully be excluded, restricted, or modified.

30. Suspension or Termination of Access

We may suspend or terminate your access to our website, account, courses, Course Notes, Extra Notes, shared folders, digital materials, live sessions, consultations, or services if we reasonably believe that you have:

  • breached these Terms and Conditions;
  • breached a separate Confidentiality Agreement;
  • shared access, login details, recordings, shared-folder links, passwords, Microsoft Teams access, live-session links, or materials without permission;
  • failed to pay or reversed payment without valid basis;
  • provided false or misleading information;
  • behaved abusively, unlawfully, dishonestly, or disruptively;
  • infringed intellectual property rights; or
  • created risk to our business, systems, instructors, contractors, students, or reputation.

Where the issue is disruptive or unprofessional behaviour that does not involve breach of confidentiality, unauthorised sharing, misuse of materials, non-payment, fraud, or similar serious access-related misconduct, Smart IMG Academy will generally limit the response to restricting live-session attendance, live participation, or direct communication access. Access to Course Notes or digital materials already properly provided should not be automatically withdrawn for non-confidentiality-related behaviour.

Where appropriate, we may provide notice and an opportunity to respond. However, we may act immediately where necessary to protect our business, users, content, or systems.

31. Governing Law and Disputes

These Terms and Conditions are governed by the laws of Queensland, Australia, and the applicable laws of Australia.

The parties submit to the non-exclusive jurisdiction of the courts and tribunals of Queensland, Australia.

Before starting formal proceedings, you agree to contact us first and allow us a reasonable opportunity to resolve the issue, unless urgent legal action is required.

32. Changes to These Terms and Conditions

We may update these Terms and Conditions from time to time.

The updated version will be posted on this page with a new “Last updated” date. Continued use of our website or services after the updated Terms and Conditions are posted means you accept the updated version.
